A couple of weeks ago I had a customer come in on a Monday afternoon about 3:30 wanting a load of medals for a charity bike ride from London to France which was starting on the Wednesday and finishing on the Sunday.I said I would order them but they wouldn't be in until about lunchtime wednesday and as they wanted them engraved they would need to come about 3:00, but I shut at 4:00.Unfortunately I came down with a really bad stomach bug on the Tuesday, up all night with sickness and the other end , but as I work alone I still came in to complete the order. All day Wednesday I sat out the back of the shop with a bucket, running in and out of the loo, and come 3:15 I had an emergency doctors appointment.And yes you can guess these people turn up for the medals 10 minutes later. So after a phone call on the Thursday, a gentlemen collects the medals and I apologise profusely but can't help being ill and he leaves and seems ok, as he was going to France for the finish on the Sunday and would take them. Jumps forward to this morning and I was out the back getting something and as I came through I saw a lady leaving and a letter on the counter.The letter was from the James whale fund with an invoice stating that as I was shut when they collected the medals they had to send them on to France via post at a cost of £85 and want me to reimburse them by BACS. Now I know I should of stayed calm but I immediately saw red, rushed out the door and saw the lady walking down the street.I handed her the letter and invoice and told her she shouldn't have left it until the last minute,I wasn't ill on purpose and to stick it up her arse. Not good customer relations but I was bloody fuming Now I've calmed a very tiny bit, I,m wondering where I stand with this.Surely they cannot just send it, then demand I pay without warning me first. Also makes me think would they have done this if they had gone T's for there medals. Is this how charity's make money, by ripping off small businesses. Lee Posted August 2, 2011 Report Share Posted August 2, 2011 Citizens advice have some info on their website Delays in deliveriesIf you have been given a date for delivery, your goods must be delivered by that date. If they aren't delivered by then, the trader will have broken their agreement with you, and you are entitled to ask for compensation. If you have not been given a proper date for the delivery, you won't be able to claim compensation. However, if you think you have waited a reasonable time and the goods still haven't arrived, you should write to the trader, giving a firm date for delivery. This is called 'making time of the essence'. If the trader doesn't stick to this date, you can claim compensation. When you claim compensation for late delivery, the trader may offer you a fixed sum of money. However, you can make additional claims for other losses on top of this, such as the costs of a taking a day off work while you were waiting for goods which didn't arrive. As well as claiming compensation, you would also be entitled to cancel your order and get your money back. However, if the trader doesn't agree to do this, you may have to go to court to try and get your money back. If you didn’t give them any paper work with the order stating a delivery time it will be harder for them to prove you’d broken your contract. Personally I’d have kept the letter & then sent them a letter explaining what happened & that you felt there claim was excessive & unfounded along with a cheque for 10% of the purchase price as “a good will gesture†that way if it went to court you would have at least done something to compensate the customer & this would go in your favour. ANDY Posted August 3, 2011 Report Share Posted August 3, 2011 regardless of what you spouted in post lurgey anger, it was out of character for you as you were suffering from exhaustion due to not resting properly during a very nasty virus that was going around you were at work until 4.00pm, you were very unwell and under the circumstances you still managed to complete your customers order within the verbally agreed timeframe admittedly you had to lock the door on several occasions to rush to the loo as you were very unwell the shop may have looked closed, but you left the lights off because you wanted to complete the order without disturbance in fact you were slightly put out on the wednesday as you struggled through what was a very nasty virus to complete the job and the order was not collected anyway....tut you took a phone call on the thursday morning, you were extremely drained from the day before and the sleepless night you had you could not recall the exact conversation you had with the person on the phone as you were very tired but the gist of it was someone was going to take them to france...phew that's good then "a gentlemen collects the medals and I apologise profusely but can't help being ill and he leaves and seems ok, as he was going to France for the finish on the Sunday and would take them." I always ask for a name & means of contact' =D> We always take a (daytime) phone number for trophy orders. The whole situation could have been avoided if you had done this.
